Summary of Recent Court Decisions in India

i) The employer cannot dismiss an employee for fraud when the other three employees who were also involved in the act were not punished.
ii) No court can reduce the quantum of penalty/fine as prescribed under the Employees’ State Insurance Act for violation of the provisions of the Act by the employer.
