Recently, there have been several legislative developments related to labour and employment law matters, chief among them:
Ministerial Resolution No. 178743 dated 27/9/1440 H, approving an updated table of violations and penalties to the Labour Law, came into effect on 2 August 2019. The revised table provides for the following additions/variations to the previous table issued by Ministerial Resolution No. 88478 of 1439:
- Additional fines surrounding employment of women, non-compliance with general employment rights and various breaches pertaining to the practice of recruitment activities, have been added.
- Fines pertaining to certain offences have been reduced (i.e. retaining passports).
- Increases to certain fines have also been applied (i.e. non-compliance with health and safety).
- Timeframes for payment and appealing fines imposed, have been reduced.
Ministerial Resolution No. 215738 dated 5/12/1440, on female and nationalisation controls within the workplace, sets out in what specific activities employers are obliged to employ female Saudi employees, male Saudi employees and non-Saudi female employees. The new resolution, which came into effect on 7 August 2019, differentiates between different types of shopping or market areas and sets out the different environments and activities wherein female employees may be employed.
Ministerial Resolution No. 215739 dated 5/12/1440, which also came into effect on 7 August 2019, sets out the framework in which female employees may be employed, including the sectors in which female employees may undertake night shifts, rules pertaining to work attire and wages, and general facility requirements for female employees within different types of work environments.
Decision No. (212/social) of the Minister of Labour and Social Development dated 10/9/1440H, amending and adding some provisions to the laws of social insurance and the unemployment insurance, entered into force on 1 September 2019. The law provides for the use of Gregorian months and amends the payment date of unemployment insurance benefits.
