The Decision amends Article 14 of the Implementing Regulations of the Labour Law (Decision of the Minister of Labour and Social Development No. 70273 of 1440 H). In line with the recent ‘National Transformation Programme’ announced in November 2020, the following changes have been made:
- Non-KSA employees may transfer employers with the approval of their current employer unless restricted by any Saudisation requirements;
- Non-KSA employees on completion of the attested fixed term contract, may transfer employers without needing to obtain any approvals. Previously this was only possible with approval of the Ministry of Human Resources and Social Development;
- Non-KSA employees may transfer employers without obtaining approval from their existing employer where (i) the employee has been in KSA for 12 months following the date of entry; and (ii) the employee serves a minimum of 90 days prior notice, save where the parties mutually agree otherwise.
