The Supreme Court of the Russian Federation in its Resolution as of 24.04.2017 No. 18- ?G 17-10 considered issues of the arrears in wages, the limitation period for going to court and salary indexation. In this Resolution the employee claimed that employer’s debt was formed long time ago due to the failure of indexation. The legislation in force at the time provided for 3-month period for applying to the court (today, 1 year). Representatives of the employee proceeded that the violation has a durable nature and the moment of the beginning of the calculation starts from the dismissal of the employee. However, the Supreme Court concluded that the obligation to carry out salary indexing can be realized through internal company rules: through increasing the skills and awards, and economic indicators.
