The draft Federal Law No. 157764-7 “On Amending Certain Legislative Acts Regarding the Establishment of Additional Guarantees for the Activities of Trade Unions” has already been adopted in the second reading in the State Duma of the Russian Federation. The RF Labor Code and the Federal Law as of 12.01.1996 No. 10-FZ will be supplemented by the following innovations: 1. The obligation of creating collective agreements. Nowadays it works only on employees’ initiative. Also the requirements set the content of the collective agreement. 2. The right of the trade union to apply to a court. Without this rule, some courts do not accept claims (without the employee’s application). 3. Prohibition of directors to head the trade union. The supervisory management of a company can no longer be the head of the trade union. Also, the head will be deprived of the right to negotiate, to conclude collective agreements and agreements on behalf of workers.
