New law in Russia that allows all HR documents to be kept electronically came into force on 22 November 2021
On 22 November 2021, the President signed Federal Law No. 377-FZ; the new law supplements the Labour Code of the Russian Federation with new articles 22.1-22.3, which regulate management of employment related documents in electronic form.
All HR documents can be converted into electronic form without duplicating them on paper, except for the Act on the workplace accident, dismissal order and documents confirming that the employee was instructed on occupational health and safety standards. Labour books will also remain in hard copy (paper copy) form, unless employees choose to keep their employment records in electronic form only.
Key Action Points for Human Resources and In-house Counsel
It is up to the employer to decide whether or not to switch to electronic document management. To date, this law does not impose any obligations or restrictions on this issue. Still, the electronic format is quite obviously the wave of the future. As such, we recommend to analyse the new options and the company’s IT resources in order to understand the pros and cons and the actions required for the transfer from paper to electronic.
