A part-time employee cannot be dismissed for a fake diploma while on a maternity leave. The Moscow Regional Court in its Resolution of 11.07.2016 in case No. 33-18563 / 2016 determined that to dismiss such worker, an employer needs to wait for expiration of the leave (in Russia it could be up to three years). However, it is possible to collect evidence of a sham of a diploma. It may be done by making a request to the institution where the employee ought to study. If they confirm that the employee has not studied there and the diploma with the specific number has not been issued to him/her, after the release from the leave, the employment contract can be terminated.
