The provisions of the Dismissal Decree and the substantive standards of the policy rules set by the Employee Insurance Agency are reflected in the Work and Security Act, the regulations following therefrom and the explanatory memorandum. Issues that follow from the policy rules of the Employee Insurance Agency are – among others – data, which an employer should provide to substantiate the economic necessity of a reorganization. With the publication of the implementation rules, the Employee Insurance Agency clarifies the reasoning behind the required and obligatory data and the manner in which a dismissal application, on economic grounds or because of long-term disability, will be assessed. New versions of the policy rules of the Employee Insurance Agency were adopted in July 2016.
