As per the resolution of the Supreme Court (III PZP 3/16), despite the fact that the 7 or 14 day period for appeal to a labour court against the termination (7 days with notice period and 14 days without notice period) passed, an employee has the right to claim compensation, if the reason for termination or criterion for the selection was discriminatory. The employee has the right to claim compensation until the claim is lost by prescription (3 years after the date when a claim became enforceable).
