The amendments will bring revolutionary changes to the way of keeping employees’ personal files.
The amendments will introduce a digital form of keeping the personal files, which is a novelty in the Polish legal system. From January 1st 2019 employers will have a possibility to choose the form of the personal files kept by them. They will be able to stay with the paper-document form or switch into the newly introduced digital one.
Nevertheless, the technical requirements of the digital form of personal files are not known yet, as the regulation specifying the content of the amendment act has not been issued.
Moreover, the period of storage of the personal files is to be amended. Before January 1st 2019 the period of storage was 50 years from termination of an employment relationship. The amendments will introduce a new 10-year period of storage.
