As per Supreme Court (case ID: I PK 113/14) in case an employee was dismissed on disciplinary grounds and employer insignificantly missed the 1 month deadline to deliver a termination of contract, the court may dismiss an employee’s action in case recognition of claim would be unjust under specific conditions. It is the Court’s obligation to point why the deadline was missed and qualify as insignificant and why recognition of the claim would be unjustified.
