A Nova Scotia court has imposed a “creative sentence” for a violation of the Occupational Health and Safety Act. Under that Act, the Court is able to impose “creative sentencing options”. In addition to a monetary fine of $35,000, the Court ordered the company to perform 150 hours of community service in an 18 month period. Specifically, the company was ordered to make a series of presentations on the facts of the case, the applicable regulatory requirements, the workplace safety issues involved and the required due diligence.
