The Supreme Court ruled in a recent case that an employer was allowed to withdraw a benefit given to its employees, despite the fact that the benefit had been given in individual agreements with each employee. The employer had offered two employees over the age of 60 to keep their full position with all benefits intact, but that they would only have to work 80 %, as a senior benefit. Unlike the court of appeals, the Supreme Court found that the agreement could be unilaterally withdrawn by the employer. The Supreme Court found that an individual agreement with an employee is not in and of itself sufficient to limit the management prerogative, and that in this particular case the content of the agreement was not considered to bind the employer.
