The first case law appeared on the statutory notification period that applies as per 1 January 2015. Based on this notification period, the employer must inform the employee at least one month before a fixed term contract will expire, whether or not the contract will be extended, and, if so under which conditions.
- The Cantonal Court of Leeuwarden ruled on 13 May 2015 that the employer who failed to notify the employee, had to pay the employee one month’s salary.
- The Cantonal Court of Utrecht considered in its judgement of 13 May 2015 that it is permitted for the employer to notify the employee at the time of concluding the employment agreement by including a notification clause in the employment contract.
