By Court Ruling no. 10955/2015, the Italian Court of Cassation has ruled that it is not unlawful for an employer to create a fake Facebook profile in order to uncover an employee’s negligence. In the case in question, the employer created a fake female Facebook profile and started chatting with an employee in charge of the printing press. The employer then dismissed the employee because, in chatting with him, it discovered that the employee was on Facebook during working hours, and that the employee had not fixed a problem with the printing press because he was busy with a private phone call. According to the Court, this kind of behavior by the employer was lawful and valid because, while respecting an employee’s dignity and freedom, monitoring employees is permitted if the purpose of same is not to evaluate the working performance, but, for example, to avoid risk of damage to company property.
