Most States in India, especially those with a significant IT industry, have created several exceptions to labour laws applicable to establishments in this industry:
- Several States such as Maharashtra, Karnataka, Andhra Pradesh, Telangana and Manipur have created exceptions to their respective Shops & Establishments Act to allow women employees to work night shifts;
- Many States (including those listed above, plus states such as Haryana, Uttar Pradesh, Rajasthan, Punjab and Gujarat) have exempted IT/ITES companies from maintenance of physical employee registers, and such companies can instead maintain only electronic records; and
- Manipur, Andhra Pradesh and Telangana have declared the IT industry under their respective Essential Services Maintenance Act, which effectively makes any industrial action among the IT industry in these States illegal.
