The Federal Government has published a Draft Labour Code on Industrial Relations Bill, 2015. As part of the changes proposed under the Draft Code, the following amendments would be made to the Standing Orders:
- All forms of harassment, including sexual harassment, have been classified as “misconduct”;
- Certain provisions of the Model Standing Orders, such as those which are required to be in a particular manner because of the application of another legislation, will override and prevail over any contrary provisions contained in the establishment’s Standing Orders;
- Quantum of “subsistence allowance” paid to employees who have been suspended pending investigation into alleged misconduct, has been increased; and
- Investigations against an employee must be completed with 90 days of commencement.
