In application of the Labour law of August 8, 2016, a decree has reinforced the rules aimed at reducing the illegal use of international services. The supervisor’s vigilance obligation has now been extended to the entire chain of subcontractors. A company that uses foreign service-providers will have to make a declaration with the labour administration stating that it is aware of the secondment of employees on the national territory and the relevant regulations. The time requirements for declaring a workplace accident involving a seconded employee have been set out. Administrative sanctions such as the temporary closing or the halt of activity are now possible. Such obligations in the transport and construction industries have been modified. These provisions will enter into force on July 1 ,2017.
