An Act of Parliament known as the loi El Khomri has now been passed. Henceforth, company-wide agreements in respect of working hours will prevail over the extended Collective Bargaining Agreement; it amends the rules for altering and terminating collective agreements, and entirely changes the law on collective bargaining. It clears up various issues in relation to the Works Council and Health & Safety Committee, alters the procedure for physical disability, redefines redundancy criteria, and allows agreements to be signed for the purpose of safeguarding and fostering employment. Following a challenge filed with the Conseil constitutionnel, the Act has not yet been promulgated.
