The draft bill n° 6892 on the equal treatment of men and women has been voted by the Chamber of Deputies. The labour law part of the new legal provisions provides for the following:
• Insertion of a new chapter V on the equal treatment of men and women into the Labour Code;
• Obligation of the employer to grant the same remuneration for the same or a similar position. The new legal provisions define the notions “remuneration” and “similar position” in this respect;
• Sanctions in case of non-respect of the legal provisions
o Nullity of any provision not reflecting the above obligation (as per law),
o Automatic substitution by the higher remuneration (to replace the unenforceable provision),
o Fine of EUR 251 to EUR 25,000, which is doubled in case of another breach within a period of 2 years.
