On January 19, 2016, PRC Ministry of Human Resources and Social Security released a Draft for Comments of the Opinions on Certain Issues Regarding Implementing the Work-Related Injury Insurance Regulation (“the Draft for Comments”). The Draft for Comments provides some opinions on certain unclear issues in practice when implementing PRC Work-Related Injury Insurance Regulation. For instance, considering many companies operate their business at different places, the Draft for Comments provides that a company could participate in the work-related injury insurance at the place of its business operation if the company does not participate in it at the place of registration. In addition, the Draft for Comments emphasizes that if a labor dispatch company dispatches an employee to a different region, it shall contribute to work-related injury insurance for the dispatched employee at the place where the labor accepting company is located. We are expecting that the Draft for Comments will be officially issued soon after.
