On May 6, 2016, Office of Legislative Affairs of the PRC State Council issued a Circular on Soliciting Public Opinion of Emergency Regulation of Production Safety Accidents Other Observations (“the Draft for Comments”). The Draft for Comments requests that companies engaging in production activities shall make a contingency plan according to the type, feature and damage of the possible production accidents and release it to the employees. In addition, the said companies shall organize emergency exercises regularly (at least every 2 years) based on its contingency plan. Furthermore, the companies engaging in production activities shall organize emergency training to employees and equip the employees with necessary knowledge concerning risk prevention and emergency reactions. This Draft for Comments also imposes duties (e.g. establishing a rescue team or at least appointing rescue persons within the company) on companies, especially companies producing, selling, storing, and transporting hazardous products and companies engaged in metal smelting, city transportation, construction operations, etc.
