On July 27, 2016, the Ministry of Transport and six other departments promulgated the Interim Administrative Measures for the Operation and Services of Taxis Subject to Online-appointment (hereinafter referred to as the “Interim Measures”), which will come into effect on November 1, 2016. Compared with the draft of the Interim Measures issued by the Ministry of Transport in October 2015, the Interim Measures do not mandatorily require the platform company of tailored car services to sign employment contracts with the car drivers. Instead, it increases flexibility by providing that the platform company of tailored car services shall sign employment contracts or other agreements to specify both parties’ rights and obligations based on relevant laws and regulations, and also the driver’s working hours, service frequency and other factors. In addition, the Interim Measures provide that the platform company of tailored car services shall safeguard drivers’ legitimate rights and interests, and offer them pre-job training and daily education on laws and regulations, professional ethics, service rules, safety operations, etc. Also, the platform company shall ensure the drivers online are the same as the drivers offline, who actually provide services, and file relevant information of drivers with the local administration in charge of taxis.
