Recently, after leaving the company, Mr. Xu claimed that the company had withheld part of his salary without his approval, and Mr. Xu asked for the repay of the corresponding portion. Although his claim was rejected by the labor arbitration commission, Mr. Xu then brought a lawsuit before the court. During the court trial, the company contended that it would withhold 1 RMB from every employee’s salary every month and that amount of money would later be donated to charity utility by the trade union. The court concluded that donation shall be subject to every employee’s own consent and the company shall not withhold any part of the salary without the employee’s prior consent. Therefore, the court ruled in favor of Mr. Xu and the appeal court also maintained such decision.
