Li was an employee of a real estate development company. In 2009, he purchased an apartment of a project developed by his company as an employee at a relative low price by signing a purchase agreement and a preferential agreement with his company, which provides that he has to pay the compensation for price difference if he resigns within the stipulated service term. Then Li received the apartment and lived in it. However, he resigned one month in advance before the end of his service term. So, his company brought a lawsuit against him, claiming for compensation for price difference.
After the trial, the court held that the preferential agreement was attached to the purchase agreement and revealed true intentions of both parties. Li resigned within the stipulated service term, which violated the agreement. Therefore, the court ruled that Li should pay the compensation for price difference about RMB 300,000.
