On April 29, 2016, the Human Resources and Social Security Bureau of Shanghai Municipality released the Circular of the Human Resources and Social Security Bureau of Shanghai Municipality on Certain Issues Concerning the Application for Maternity Insurance Benefits in Shanghai Municipality (the “Circular”). The Circular provides that from July 1, 2016:
(1) if a female employee who has participated in the maternity insurance in Shanghai gives birth or suffers a miscarriage, she can apply for the maternity insurance benefits from the local social insurance administrative institution according to relevant regulations;
(2) if the employer has paid the maternity insurance premium cumulatively for 12 months or continuously for nine months for the female employee by the month when she gives birth or suffers a miscarriage, the maternity living allowance shall be covered in the full amount by the maternity insurance fund; and
(3) if the employer has paid the maternity insurance premium cumulatively for less than 12 months and continuously for less than nine months for the female employee by the month when she gives birth or suffers a miscarriage, the maternity living allowance shall be paid pro rata based on the contribution months of maternity insurance premium (contribution months÷12), and the remaining part shall be paid by the employer in advance.
