In order to prevent social dumping in the transport sector, the principle that an employee who works in different countries, is subject to the law of the country in which the employee usually carries out his/her work, will be introduced in the Belgian legislation. In that manner, the government wants to anchor the case law of the Court of Justice in the Belgian legislation. Courts will have to take different criteria into account in their judgments, such as e.g. the place where the employees receives his/her instructions, the place where the work instruments are located, …, to determine the applicable law. The pre-draft of bill will now be submitted to the Council of State for advice.
